Personal data Protection Policy

Personal data, as detailed below, provided by you when you access, register or subscribe to https://fja.ar/ (hereinafter referred to as the “Site”) will be processed for the purposes detailed in this policy.

The entity responsible for processing the aforementioned personal data is Francisco J. Abelló y Asociados S.A. (hereinafter, “FJA”), a corporation conducting business and commercial activity in Argentina and other countries, especially in the Americas and Europe, bearing CUIT (Taxpayer’s identification) number 30-70714073-5 issued by AFIP (Federal Administration of Public Revenue) of the Argentine Republic and registered under number 1675154 at IGJ (Record Office of Legal Entities) under the Ministry of Justice and Human Rights of the Argentine Republic. FJA is the entity that decides on the processing of personal data. To this effect, it determines the purposes or uses for which the personal information will be used and the means that will be used for such processing, which are specified in this policy under section “Purposes and legitimacy of the processing of personal data”.

 

Personal data

Personal data (“Personal Data”) are those provided by the user when accessing, browsing, using or registering on the Site and for using its contents, products or services. The user shall provide truthful information regarding their Personal Data and keep them updated (to communicate any modification, see section “Rights of the interested parties”). Users who provide false information may be excluded from the services to which they belong.

 

Purpose and legitimacy of the processing of Personal Data

FJA will process your Personal Data for the following purposes and in accordance with the following legal bases of legitimacy:

a) Management and control of the user’s registration on the Site and of any request, subscription or other contracting made by the user on the Site in accordance with this policy and with the terms and conditions applicable in each case. The legitimacy for this purpose of processing Personal Data relies on the consent given by the user for access, browse or use of the Site, or, where appropriate, the execution of the contract, to which the user is a party, for the maintenance, compliance, development, control and execution of the contractual relationship established between you and FJA.

b) Execution of personalized commercial actions -based on a commercial profile constructed by FJA pursuant to information provided by the user- by electronic means or not, with regards to services and contents (described below) offered on this website. The legitimacy for this purpose of processing your Personal Data is the consent of the user. You have the right to withdraw your consent at any time in accordance with the procedure established in the section “Rights of the interested parties”, without affecting the legality of the processing based on consent prior to its withdrawal.

c) Sending of commercial communications or newsletters by any means, including electronic, about FJA’s services, similar to those that the user has consented to receive or previously contracted. The legitimacy for this purpose of processing your Personal Data is the legitimate interest of FJA to improve its services, contents of the Site and user experience.

d) Analysis of the user’s needs, tastes and preferences to personalize contents and services shown to the user in particular. For this purpose, FJA uses cookies and other data storage and retrieval devices. The user is informed that the processing of Personal Data obtained through cookies and the aforementioned data storage and recovery devices shall be carried out in accordance with our Cookies Policy and this Privacy Policy. The legitimacy for this purpose of processing your Personal Data is the legitimate interest of FJA to improve its contents and the user’s consent for the use of cookies. You can configure at any time the cookies you accept as detailed in the Cookies Policy.

 

Recipients of personal data

It is important that you know that, in some cases, it is necessary for us to communicate the information you have provided to companies that provide us with IT-related services or marketing agencies, with whom we outsource certain services related to the data processing we perform. In these cases, we ensure that such third parties comply with the regulations on the protection of personal data. No data will be communicated to other third parties, unless legally required. No transfers of personal data to third countries or international organizations are foreseen.

 

Retention of personal data

Your data will be kept as long as there is a mutual interest in maintaining the record, or as long as you do not exercise your right of deletion, opposition or limitation of processing. We only retain your Personal Data for as long as we need it for the purpose for which we process it, to meet your needs, for the execution of the contractual relationship established between you and FJA or to comply with our legal obligations. Once your relationship with FJA has ended, we may keep some of your Personal Data as long as it is necessary to comply with our legal or regulatory obligations, derived from the contractual relationship established between the user and FJA, as well as to meet any responsibilities arising from its processing.

 

Rights of the interested parties

The applicable regulations regarding the protection of personal data grant certain rights over your personal information (“Rights of the interested parties”), among which are:

  1. (a) Access.
  2. (b) Update
  3. (c) Rectification.
  4. (d) Cessation of sending advertisements, offers and promotions.
  5. (e) Deletion.
 
 

The rights of the interested parties may be exercised through the contact information details provided and, in accordance with Argentine Law no. 25,326 on the Protection of Personal Data, by writing to Av. Leandro N. Alem 896, 9th Floor, Autonomous City of Buenos Aires (C1001AAQ) or by email address: fja@fja.ar , indicating your name, surname and postal address, and attaching a copy of your ID, passport or other identification document. Likewise, in case of non-satisfactory response in the exercise of your rights from the entity responsible for processing personal data, you can file a claim with the Agency of Access to Public Information.

If by registering on the Website you have given your consent for the purposes for which it has been requested, you may withdraw it by following the procedure established in the preceding paragraph. The withdrawal of the consent given shall not affect the use that you may make of the Site or the lawfulness of the processing of said consent prior to its withdrawal.

 

Minors

Unless otherwise clearly specified in relation to a service or content available on the Site, the services or content mentioned are not directed to minors; and if FJA suspects or becomes aware at any time of the registration of a minor, it will proceed to cancel the registration and prevent access or use of the corresponding services or content with respect to such person.

 

Applicable legislation and competent jurisdiction

This Privacy Policy shall be governed by the laws of the Argentine Republic. In the event of any controversy or divergence related to the interpretation, validity, execution, or fulfillment of it, you and FJA shall submit to the exclusive jurisdiction of the national courts of the Autonomous City of Buenos Aires, expressly waiving any other jurisdiction and/or venue that may correspond to them.
